Kalam Party Hire
Terms and Conditions for Hire of Goods and Services
These are our standard terms and conditions between Kalam Party Hire (the owner) and you (the hirer). By signing this agreement or paying us any fees or taking possession of our equipment you agree to be bound these terms and conditions.
1. Definition
a. The “owner” or “we” means Kalam Party Hire.
b. “Owner’s Premises” means the owner’s usual business place i.e., the premises where the Owner stores the Equipment (274 North East Road Klemzig SA 5087).
c. “Hirer” or “you” means the legal entity or person hiring the equipment from the owner.
d. “equipment” is any goods or equipment we offer for hire
e. “site” means agreed address that the hirer provides us and uses hiring equipment at.
2. General
a. Electronic communication in the form of email is an accepted form of written communication for this agreement.
b. Equipment must only be used at the site or sites (the site) specified in the quotation and may not be sub hired without the approval from the owner.
3. Liability
a. The owner is not liable for any kind of injury, death or other damages that may arises from the use of the hiring equipment or the actions of the hirer.
b. The hirer accepts complete responsibility for the use and operation of the hiring equipment. The hirer agrees to release and fully indemnify the Owner against any third-party claims, demands, suits, expenses, and costs, for damage or injury or death to any persons or or property arising directly or indirectly out of the hire or use of the Equipment.
c. Once the Owner has delivered the Equipment or the hirer has collected the Equipment, it is the responsibility of the hirer to handle and operate the equipment in a proper, safe, and careful manner and only for the purpose and capacity for which it was designed.
d. If on the any occasion the equipment develops any electrical, mechanical, or any other fault during the correct manner of use whilst on hire then it is the hirer’s responsibility, to ensure safe, to shut down, switch off or cease to operate or handle the Equipment.
4. Seating
a. You will get the chairs, tables, and other items clean and return in clean condition. If these are not clean, small fees like 2$ per chair and 3$ per table may be applicable and will be charged from the bond.
b. Please do not stack these in an open area when you do not use them. Otherwise, these might get dusty.
c. It is mandatory to use wraps or covers for the tables.
d. Please give the chairs and tables a wipe or use water spray to clean after your party.
e. At any case, do not stand on the chairs. Chair weight rating 95Kg. The hirer must use chairs within the capacity limit.
f. Table covers laundering is our responsibility but please return in fair condition e.g., no dust, food particles etc.
5. Damage or loss of Equipment
a. If any equipment is broken or damaged, it must be reported while returning.
b. The hirer will have to pay replacement for any damaged or missing equipment at current market rate
c. It is the responsibility of the hirer to confirm the condition of all equipment is undamaged prior to the hire period and that all equipment is present at the time of pick up, delivery or set up as detailed in the quotation.
d. If there is a defect, incorrect or missing equipment we must be notified within a reasonable time. Any notification must include specific details of the issue.
e. If we are not notified within 1 hour of you gaining possession, this will be taken as agreement that the equipment provision requirements of this agreement have been met.
f. It is the responsibility of the hirer to have an adverse weather plan in place for any event that may be affected by weather. All equipment must remain protected from weather.
g. All the packaging is part of the hiring equipment and must be returned. Replacement fees for packaging will be charged from the bond if packaging is not returned in same condition.
6. Catering
a. Bain Marie, Tea/Coffee flask, Hot water urn should be washed, cleaned, dried after use.
b. Bain Marie usage policy will be briefed on pick up. Please follow the guideline. If you take fuel, please be careful. We will not take any responsibility for any accident caused by fuels.
c. The hirer is fully responsible for using the hot items in correct manner
d. Soup warmer, Drink dispenser and drink tubs should be washed and rinsed
e. Esky and drink tubs should be rinsed and dried properly
7. Other items
a. All equipment must be returned in a reasonably clean manner as determined by us.
b. Mesh backdrop must not be returned with any strings, threads, scotch or adhesive tape, glues, or cable ties
c. Plinths should not have anything attached e.g., no adhesive or glues.
d. White disc needs to be returned as clean with no marking or writing.
e. Cake stands should be cleaned to make free of any food.
f. Equipment should not be returned with any single attachment that hirer put on.
8. Picking Up
a. Pick up and drop off by appointment only (only agreed time by both parties).
b. Please take sufficient steps to secure your vehicle when you carry chairs, tables, mesh backdrop or any other items. Please bring enough mats or clothes or wraps to cover the inside of your vehicle so that items don't cause any scratch or any other damage. It is all your responsibility to ensure safety and security while carrying.
c. Full amount must be paid before picking up. Payment method cash or EFT POS. Credit card surcharge 1.1% is applicable.
d. The hirer agrees to show photo identification at the time of pick up.
9. Delivery
a. Full amount and a refundable bond must be paid and cleared before delivery. Only payment method for delivery is bank transfer (Kalam Party Hire, BSB: 062692, Account Number: 39563448, Ref: Booking name.
b. The delivery will be a kerb side or driveway delivery. Same for picking up. If you need more support, please let us know now.
c. If the hirer requests the delivery persons to carry equipment inside that will cost at least 10$ extra on each occasion. The hirer needs to pay the extra fees.
d. Refundable bond will be paid after return of equipment in the same good and clean condition as delivered.
e. Chairs or tables or any other furniture need to be kept stacked nicely so these are ready to be picked up
10. Payment & Cancellations
a. If debt recovery action be required, the Hirer is liable to pay any costs incurred by the owner associated with the recovery of the Hirer’s debt.
b. The owner reserves right to cancel the booking at any time if the full payment is not made before picking up or delivery. The owner reserves right to forfeit any partial payment to cover any loss in such cases.
c. A 30% fee applies all cancellations received within fourteen (14) days prior to the delivery or collection date.
d. A 50% (of total order value) fee applies to all cancellations received within 7 days prior to the delivery or collection date.
e. A 100% (of total order value) fee applies to all cancellations received within less than 7 days prior to the delivery or collection date.
I have read and understood the terms and conditions and confirm once possession of the Equipment is taken from the Owner.
